Domain Name Registration and Website Hosting Fees.
In relation to domain name registration, Newcastle Creative Media will attempt to register your preferred domain name. If Newcastle Creative Media cannot register the domain name of your choice, you must choose an alternative name. Every procured domain name registration is subject to any published terms relevant to that domain name.

Domain name and website hosting fees are payable on a regular basis.
You acknowledge that you are responsible for paying these fees when they are due.

Content supplied to Newcastle Creative Media.
You warrant that all content that you supply to Newcastle Creative Media complies with all applicable laws and does not breach or infringe any other person's rights (including intellectual property rights) or licence to use, or exploit any patent, copyright, trademark or trade secret information, or any other proprietary right. You also ensure the accuracy of all information contained in the content.

Accounts Payable.
Relevant fees payable to Newcastle Creative Media may include any expenses incurred in collecting unpaid fees (including debt collection agency fees and legal costs to the fullest extent permitted by law).

Indemnification.
You hereby indemnify Newcastle Creative Media against any action, liability, claim, loss, damage, proceeding, expenses (including legal costs) suffered or incurred arising from , or which is directly or indirectly, related to: (1) your breach or non-observance of any term of this agreement; (2) any breach or inaccuracy in any of your representations or warranties; (3) any action or claim brought by a third party which relates to all or any part of the content of your website; or (4) the development, operation or maintenance of your website.

Limitations of Liability.
Newcastle Creative Media does not guarantee continuous, uninterrupted or secure access to your website. Newcastle Creative Media is not responsible for any deletion, alteration or loss of data due to network or system outages, file corruption, accidental deletion or for any other reason whatsoever. Newcastle Creative Media does not guarantee server reliability, website availability, speed or consistency.

Newcastle Creative Media, its employees, agents and licenses are not liable for any direct, indirect, incidental, special, economic or consequential loss or damage or loss of revenue, profits, goodwill, opportunities or loss of anticipated savings incurred or suffered by you.

Newcastle Creative Media makes no representations or warranties about any other website and is not responsible for the accuracy of any information on any other website which you may access through your website. When you access any other website, that other website is independent from your website and Newcastle Creative Media has no control over the content of that website.

Newcastle Creative Media will not be responsible or liable for the acceptance of your website with any search engine and does not guarantee placement of your site on any search engine. Additionally, Newcastle Creative Media makes no guarantee of where your website will be ranked or positioned on any search engine listing your website. You acknowledge that Newcastle Creative Media has no control over the content of a search engine.

General provisions. A) Newcastle Creative Media's failure to enforce any provision of this agreement shall not constitute a waiver of any rights. B) These provisions constitute the entire agreement and supersede all prior agreements. C) If any provision of this agreement is deemed to be invalid or unenforceable, such a determination shall have no effect on any other provision. D) This agreement is governed by the laws of the State of Victoria, Australia and you consent to submit to the jurisdiction of the Court of Victoria regarding any disputes arising or relating to these Terms and Conditions.

Termination. Unless otherwise stated this Agreement may be terminated at any time in writing by post or email.
